법무법인 삼양은 S 주식회사, Y 주식회사(이하 ‘사업자들’)를 대리하여 입찰 담합행위로 인한 영업정지 및 자격정지 처분을 취소하는 미국 정부와의 행정적 합의를 이끌어냈습니다. 

사업자들은 2016년부터 2019년까지 한국 전역의 미군 기지에서 수행하는 15건의 건설 및 엔지니어링 관련 계약에 관하여 입찰 및 가격 담합을 했다는 혐의로 영업정지 및 자격정지 처분이 예정되어 있었습니다. 또한, 미국 정부는 위 담합행위가 입찰 과정에서 경쟁을 억제하고, USACE(US army corps of engineers, 미육군공병병과[단])가 더 많은 비용을 지불하게 되었다고 보아 사업자들을 기소했습니다.

법무법인 삼양은 주한미군·미 육군·국방부·기타 연방 법 집행 기관과 적극적으로 협력하여 사업자들이 합의금을 지급함으로써 미국이 사업자들에 대해 가지는 민사 및 행정적 금전 청구를 면제하기로 합의하고, 관련 형사사건에서 불송치결정을 이끌어내는 최선의 성과를 거두었습니다.

Through an agreement with the U.S. government, Samyang has successfully negotiated an administrative settlement to cancel sanctions (related to bid-rigging) and the decision for non-deportation. Acting on behalf of S Corporation and Y Corporation (hereafter referred to as 'the companies'), Samyang has led the administrative agreement with the U.S. government to revoke the business suspension and disqualification imposed due to bid-rigging practices.

The companies were under investigation for allegations of bid-rigging and price collusion regarding 15 construction and engineering contracts performed at U.S. military bases throughout South Korea from 2016 to 2019. As a result, they were facing imminent business suspension and disqualification. Furthermore, the U.S. government has prosecuted the companies, as it believed that the aforementioned collusion hindered competition in the bidding process and led to increased costs for the USACE (U.S. Army Corps of Engineers).

Samyang Law Firm actively collaborated with U.S. Forces Korea, the U.S. Army, the Ministry of National Defense, and other federal law enforcement agencies to reach an agreement whereby the companies agreed to make settlement payments, thereby exempting them from civil and administrative monetary claims brought forth by the United States. Additionally, Samyang Law Firm achieved the best possible outcome by securing a decision of non-deportation in the related criminal case.
